Terms of Service
These terms govern the use of Trendiose, operated by [FULL LEGAL NAME], [POSTAL CODE] [CITY], Austria (see Imprint). Last updated: [DATE].
1. The service
Trendiose analyses publicly available social-media data with the help of AI and presents current content trends, optionally matched to channels you add. Trend information is generated by AI and provided for inspiration only — we do not guarantee its accuracy, completeness or that acting on a trend will produce any particular result.
2. Account
An account is created by signing in with Google. You must provide truthful information and may only operate one account. You are responsible for activity under your account. You can delete your account at any time in Settings.
3. Free trial and paid plans
- New accounts receive a 8-day free trial with Starter-plan features. No payment method is required; the trial ends automatically and never converts into a paid subscription on its own.
- Paid plans (Starter, Pro, Studio) are billed in advance (monthly or annually, as chosen at checkout) via our payment provider Stripe, at the prices shown on the pricing page at the time of purchase. [PRICES INCLUDE / DO NOT INCLUDE VAT — align with your VAT status.]
- Subscriptions renew automatically each month until cancelled. You can cancel at any time via "Manage billing" in Settings; the cancellation takes effect at the end of the current billing period, and no further payments are charged.
- We may change prices for future billing periods with at least 30 days' notice; if you do not agree, you can cancel before the new price takes effect.
4. Right of withdrawal for consumers (Rücktrittsrecht, FAGG)
If you are a consumer in the EU, you may withdraw from a paid subscription within 14 days of purchase without giving reasons. By starting the subscription immediately, you request performance of the service before the withdrawal period expires; in the event of withdrawal you owe a proportionate amount for the service already provided (§ 16 FAGG), which we deduct from your refund.
To withdraw, send an unambiguous declaration to [CONTACT EMAIL]. You may use this model form:
— To [FULL LEGAL NAME], [ADDRESS], [CONTACT EMAIL]: I hereby withdraw from my contract for the Trendiose subscription, ordered on [DATE]. Name, account email, date. —
5. Acceptable use
- No automated scraping, bulk extraction or resale of the service or its data.
- No attempts to disrupt, overload or gain unauthorised access to the service.
- Feedback and other submitted text must not be unlawful or abusive.
We may suspend or terminate accounts that violate these rules.
6. Third-party services
Trendiose uses YouTube API Services. By using Trendiose you agree to be bound by the YouTube Terms of Service (see also the Google Privacy Policy). Payments are subject to Stripe's terms. Links to third-party videos lead to external platforms we do not control.
7. Intellectual property
The Trendiose software, design and content are protected. You receive a non-exclusive, non-transferable right to use the service for your own content-creation work during your subscription. Video metadata shown in the app remains the property of its rights holders.
8. Warranty and liability
Statutory warranty rights of consumers remain unaffected. We aim for high availability but do not warrant uninterrupted operation of a service at this price point; scheduled or necessary maintenance may cause short interruptions. We are liable without limitation for damage caused intentionally or by gross negligence, and for personal injury; liability for slight negligence (except personal injury) is excluded. Mandatory statutory liability (e.g. under product liability law) remains unaffected.
9. Changes to the service and these terms
We may develop and change the service (features may be added, changed or removed). We may amend these terms with at least 30 days' notice by email or in-app notice; if you do not agree, you may terminate before the changes take effect. Changes that are purely beneficial or legally required may take effect immediately.
10. Final provisions
Austrian law applies, excluding its conflict-of-law rules and the UN Sales Convention. For consumers, the mandatory consumer-protection provisions of their country of residence remain unaffected, and statutory places of jurisdiction apply. Should individual provisions of these terms be invalid, the remainder stays in force. Consumer dispute resolution: see Imprint.
